Terms and Conditions for Using the SMSEagle Demo Account

The SMSEagle Demo Service (hereinafter referred to as the “Demo Service”) is a platform designed to help users explore and become familiar with the features of SMSEagle devices. These Terms and Conditions govern the use of the Demo Service.

1. About Us

The Demo Service is owned and operated by Proximus Sp. z o.o., registered in the Register of Entrepreneurs maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS number: 0000956902. The company’s registered office and service address is Piątkowska 163, 60-650 Poznań, Poland. Tax Identification Number (NIP): 7812032643, REGON: 521369644 (hereinafter referred to as the “Service Provider”).

2. General Terms

  1. The Demo Service allows users to remotely access a physical SMSEagle device and explore its functionalities in a test environment.
  2. The Demo Service is intended solely for testing and demonstration purposes. It must not be used for commercial or production activities.
  3. The Demo Service is provided free of charge and limited to 14 days from the date of account activation.

3. Registration and Access

  1. To access the Demo Service, users must complete a registration form. An access code which allows full activation of the Demo Service will be sent to the phone number provided during registration.
  2. By submitting the registration form, the user confirms that they have read and accepted these Terms and Conditions and agrees to comply with all applicable laws.
  3. Each user is permitted to have only one active Demo Service account.
  4. To prevent abuse, the system restricts multiple registrations using the same phone number. Multiple registrations using the same phone number may result in rejection or suspension of the account.

4. Scope of Functionality

  1. Users are granted access to most features of SMSEagle devices, with the exception of the “Settings” menu and user management functionalities, which are disabled for security reasons.
  2. Each demo account is credited with 30 SMS credits, where one credit allows the sending of a single SMS message (up to 160 characters). Messages exceeding this limit will consume additional credits.
  3. Once all credits are used, the ability to send messages will be disabled.

 

5. User Responsibilities

  1. Users are fully responsible for any content transmitted via their Demo Service account.
  2. It is forbidden to use the Demo Service account for improper, fraudulent, immoral, or unlawful purposes, or to transmit defamatory, offensive, illegal, abusive, obscene, or menacing material.
  3. You must not use the Demo Service account to send unsolicited trading information (SPAM).
  4. Any violation of these Terms, such as sending illegal, offensive, or spam content, may result in immediate account suspension.
  5. The demo account is strictly for evaluation purposes and must not be used in any commercial or production environment.
  6. Users are responsible for maintaining the confidentiality of their login credentials and must not share them with third parties.

6. Service Provider Rights and Responsibilities

  1. The Service Provider reserves the right to monitor demo account activity to ensure service integrity and prevent misuse.
  2. The Service Provider is not liable for any actions taken by users that violate applicable laws or these Terms and Conditions.
  3. After the demo period ends, a Service Provider representative may contact the user to collect feedback and offer further assistance.
  4. The Service Provider reserves the right to block or suspend any account in the event of a breach of these Terms, suspected misuse, or any form of abuse.

7. Technical Support

  1. During the demo period, users have access to SMSEagle technical support via the chat window available within the demo interface.

8. Processing of Personal Data

  1. The administrator of personal data of users using the demo account is Proximus Sp. z o.o. with its registered office at 163 Piątkowska Street, 60-650 Poznań.
  2. Personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
  3. Providing personal data, such as your e-mail address and phone number, is voluntary, but necessary to access the demo account and use the service.
  4. Personal data is processed for the purpose of:
    • provide the Demo Service account and provide the ability to use its functions,
    • implementation of the legitimate interests of the administrator, including after-sales contact and marketing activities (on the basis of the user’s consent),
    • fulfilling obligations resulting from the provisions of law.
  5. The Administrator makes every effort to ensure that the processed data is protected against unauthorized access, loss or modification, using appropriate technical and organizational measures.
  6. The User has the right to access their data, rectify it, delete it (“the right to be forgotten”), limit processing, object and request data portability.

9. Final Provisions

  1. Agreements concluded through Smseagle Demo Service are concluded in accordance with the Polish law and are drawn up in Polish.
  2. Amendment of the Terms and Conditions – the Service Provider reserves the right to amend the Terms and Conditions due to significant reasons, i.e. change in legal regulations; adding new Electronic Services – in a scope, in which such changes influence the execution of provisions of these Terms and Conditions. The amended Terms and Conditions are binding for the Service User, provided that the requirements of art. 384 and 384[1] of the Civil Code are met, i.e. the Service User has been properly notified of the amendments and has not terminated the agreement within 14 calendar days from the notification date. In cases, where an amendment of Terms and Conditions results in the introduction of any new charges or increase of current ones, the Service User who is a consumer is entitled to withdraw from the agreement.
  3. In matters not regulated in these Terms and Conditions, the commonly applicable regulations of Polish law shall apply, in particular: the Civil Code; the 18th of July 2002 Act on Rendering of Electronic Services (Journal of Laws of 2002 no. 144, pos. 1204 as amended); the Consumer Rights Act, as well as other corresponding provisions of commonly applicable law.
